By visiting the websites "smsc.com", "smsc-ais.com", "smsc.jp", "bridgeco.com", "bridgeco.net", "k2l.de", "kleer.com", "kleernet.com", "sts.sg", "symwave.com" or "tallika.com" (collectively, the "Site"), the user agrees to the following provisions.
2. Information Collection and Use
SMSC and certain third party service providers collect information from users at several different points on the Site.
2.1 Registration to Obtain Information. In order to obtain certain information from certain portions of the Site, a user must complete a registration form. During registration for this purpose, a user is required to give contact and/or other information (such as name and email address) and may also be asked for other information (such as company name and title). SMSC uses this information to contact the user so the user can obtain the requested information (such as an electronic or paper copy of a datasheet) and for marketing/sales purposes.
2.2 Registration for Technical Support. In order to receive technical support with SMSC products or services, a user may complete a technical support request form. On such form, a user is required to give contact information and a description of the requested technical support or problem requiring support. SMSC uses this information for marketing/sales purposes and to contact the user to provide the requested support.
2.3 Registration to Access Web Pages. In order to access certain portions of the Site, a user must complete a registration form. During registration for this purpose, a user is required to give contact, company name and/or other information (such as name and email address) and may also be asked for other information. SMSC uses this information for marketing/sales purposes and to provide access to the requested portion of the site (such as distribution of a login ID to access e-services).
2.4 Browser Information. When a user accesses the Site, SMSC may collect information conveyed by the user's browser resulting from such access including, without limitation, the IP address from the computer the user is presently using, the last webpage visited by the user prior to visiting the Site, the type of browser used, and the date and time of the visit to the Site ("Browser Information"). SMSC may provide such Browser Information to third parties and/or analyze (or have analyzed) such information for marketing/sales purposes.
2.5 Third Party Service Providers Collection. SMSC hires third parties to provide specific services to SMSC, including "hosting" various portions of the Site. Portions of the Site hosted by third parties may not be identified as such. When a user visits these portions of the Site, all information provided by the user ("Provided Information") is collected and accessed by this third party and conveyed to SMSC. These third parties may also collect Browser Information. The third party's use of the Provided Information and Browser Information collected through hosted portions of the Site are subject to the privacy statements of such third party.
2.5.1 Investor Relations. A third party service provider, Thomson, hosts the "Investor Relations" portion of the Site that provides certain email alerts and webcasts. In order to sign up for email alerts, a user must provide an email address. In order to attend webcasts, a user must complete a registration form. During registration for this purpose, a user is required to give name, company name and phone number. SMSC uses this information to target potential investors and for marketing/sales purposes.
2.5.2 Surveys and Contests. From time-to-time the Site may request information from users via surveys or contests, and a third party service provider may host the survey or contest. The requested information typically includes contact information (such as name and shipping address) and demographic information (such as zip code). SMSC may share this information with the survey or contest sponsors and uses this information to notify the winners, award prizes, monitor or improve use and satisfaction of the Site and for marketing/sales purposes.
2.7 Supplementation of Information. From time to time, SMSC supplements the information SMSC receives from users on this website with information received from third party sources, information already held by SMSC or information provided by users on the website at other times or for other purposes.
3. Communications from the Site
3.1 Upon Registration. Depending on the information or access requested, SMSC may send registrants on the Site an email to verify their email address and convey a link for the user to obtain the requested information, or SMSC may contact the registrant to provide the requested customer or technical service. In addition, SMSC may send registrants news information relating to SMSC by email, regular mail or other communication method.
3.2 Customer Service. SMSC communicates with users as requested by users, and SMSC replies via email, telephone or other communication method, in accordance with the users' wishes.
4.1 Disclosure for Legal Purposes. Though SMSC makes every effort to preserve user privacy, SMSC may need to disclose personal information when required by law where SMSC has a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order or legal process.
4.2 Sharing of Information. SMSC shares information collected on the website with its subsidiaries, affiliated companies and third party service providers (as described herein).
4.3 Business Transitions. In the event SMSC goes through a business transition, such as a merger, being acquired by another company or selling a portion of its assets, users' personal information will, in most instances, be part of the assets transferred to the acquirer.
Users who no longer wish to receive communications from SMSC may opt-out of receiving these communications by sending an email to firstname.lastname@example.org . SMSC will make reasonable efforts to stop such communications within a reasonable time. Users who no longer wish to receive other communications and who have provided information via SMSC's third party service providers (such as Investor Relations communications) may opt-out of receiving these communications pursuant to such third party's policies.
This Site does not offer information intended to attract children. SMSC does not knowingly solicit personal information from children under the age of 13.
